So Mike, obviously the people, this audience that’s watching this video, is going through probate. From a real estate attorney’s standpoint, why do we have to go through probate? Why is probate necessary? Mike:
So even though someone becomes deceased, they still have an interest in a particular property. The reason you probate is that the state recognizes that those individuals, whether alive or dead, still have an interest. And once they’re deceased, if they have heirs, those heirs may inherit the interest that the deceased person has or had. So therefore, you have a process called probate that you have to run through in order to determine who the rightful heirs to the property are, who gets what, and how the property essentially is to be dispersed after the death of a particular individual.
Brad Woodall:
Okay. That’s simple enough as that, right? Probates just a legal process to find the rightful owner, right?
Mike:
Correct, correct. And to make sure that the interest of the deceased person is properly dealt with after their death.
